Terms of Service

Frenkel.ai lets you create, edit and refine images, videos, voice and other media from text and reference files. Some features run on our own servers and some are fulfilled by third-party AI providers (for example fal.ai, ElevenLabs, OpenAI, Google, xAI, ByteDance and sync.so). We may add, change or remove features and models at any time.

Generated results are probabilistic. The same request can produce different outputs, and outputs may be inaccurate, incomplete or unsuitable. You are responsible for reviewing anything before you rely on it or publish it.

You must be at least 18 years old, or the age of majority where you live, to use the Service. Keep your sign-in details confidential; you are responsible for activity under your account. Signing in with Google or Apple creates or links an account using the email address those providers share with us.

We may suspend or close accounts that breach these Terms, create risk for other users or for us, or remain inactive for an extended period after reasonable notice.

The Service runs on prepaid credits. The credit price of every action is shown before you start it and is charged when the job is accepted. If a job fails on our side, its credits are returned automatically.

Credit packs are sold through Stripe, our payment processor. Prices are shown at checkout in the displayed currency and include any applicable taxes unless stated otherwise. Credits are not money, carry no cash value, cannot be transferred and are not refundable except where required by law or where we choose to refund at our discretion. Welcome or promotional credits may expire or be withdrawn.

We may change credit prices, pack sizes and what each action costs. Changes apply to future actions and purchases only.

You keep all rights in the prompts, images, videos, recordings and other material you upload ("Input"). You grant us a licence to store, process and transmit Input, including to the third-party providers named above, solely to operate and improve the Service and to comply with the law.

Subject to these Terms and to the extent permitted by applicable law and the providers' terms, we assign to you whatever rights we hold in the media the Service generates for you ("Output"). You may use Output commercially. Because similar requests can yield similar outputs for other users, we cannot promise that Output is unique or protectable.

You confirm that you have the rights needed for every Input, including the consent of any person whose face, voice or likeness appears in it. Voice cloning may only be used with your own voice or with the documented permission of the person recorded.

We do not use your Input or Output to train our own models. Third-party providers process data under their own terms; we select providers that commit not to train on API traffic where such commitments are available.

Do not use the Service to create or share content that:

• is illegal, or infringes copyright, trademark, privacy or other rights;
• sexualises minors, or depicts non-consensual sexual content;
• impersonates a real person, or presents a real person as saying or doing something they did not, without their clear permission and appropriate disclosure;
• is intended to deceive, defraud, harass, threaten or incite violence or hatred;
• circumvents safety systems, rate limits or credit accounting, or probes or disrupts the Service.

We use automated and manual moderation. We may refuse, remove or report content and may suspend accounts that breach this section. Some providers apply their own content policies and may decline a request; the credits are returned in that case.

We aim for a reliable service but do not guarantee uninterrupted availability, particular generation times or the continued availability of any model. We may perform maintenance, and third-party providers may have outages we do not control.

The Service, its software, design, brand and documentation belong to StarkOne LLC or its licensors. These Terms do not grant you any rights in them other than the right to use the Service as intended.

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, StarkOne LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for all claims relating to the Service in any twelve-month period is limited to the amount you paid us in that period.

Nothing in these Terms limits liability that cannot be limited under applicable law, including for consumers.

You can stop using the Service and ask us to delete your account at any time by writing to the address below. On termination your access ends and unused credits are forfeited unless the law requires otherwise. Sections that by their nature should survive (content rights, liability, disputes) do so.

We may update these Terms. Material changes will be announced in the Service or by email at least 14 days before they take effect. Continuing to use the Service after that date means you accept the new Terms.

These Terms are governed by the laws of the jurisdiction in which StarkOne LLC is registered, without regard to conflict-of-law rules, and disputes will be brought before the competent courts there, unless mandatory consumer law where you live provides otherwise. Before starting any proceeding, please contact us so we can try to resolve the matter informally.
